Q.

Can you describe what occurs within SLD after a service provider submits an appeal to a SPIN change? What notifications are there after assignment of the case number? How long does the process normally take to complete? What happens if the new SP performs work and the SPIN change appeal is upheld? Tony Wening, IBM

The FCC Fifth Report and Order outlines COMAD rules for service substitutions that were later ruled ineligible. It appears the wording of the Order removes incentives for applicants to file service substitutions. There are no penalties for failing to submit a service substitution if the new equipment/service meets the posted criteria.

It would seem reasonable for the SLD to modify the service substitution procedure from one of approval to one of notification; then enforce via spot-checks and audits. This is even more reasonable when considering the long lead time between procurement decision and installation or service start, as well as rapid technological change. It could reduce the administrative burden on the applicant and save time for all concerned.

Q.

We are getting several customers that are filing their 472. They are clearly over CAP, and we can confirm that the amount they are requesting is the correct amount spent on their monthly bills. The customers are telling us that the SLD wants the amount spent on the bills in Column 14 of Block 2. Knowing that this amount is over CAP, do we still have them submit the BEAR with the over-cap amount? Mary Ann Imburgia, SBC
